Terms of Use
These terms explain the relationship between you and PaceOut when you use the app, website or related services.
What matters most
PaceOut is a family tool. An adult sets up and manages the family relationship. The app is free to download, Premium is optional, and Apple manages any in-app subscription.
The adult account holder is responsible for setup, permissions, the family plan and deciding whether PaceOut fits the household.
PaceOut is a planning and screen-time tool. It is not a substitute for supervision, medical advice, emergency services or a safety-critical monitor.
Apple displays the current local price, duration and any offer before purchase. Manage or cancel through Apple's subscription settings.
Nothing in these terms removes rights that cannot lawfully be excluded, including rights for faulty digital content or services.
1. Operator and agreement
PaceOut is operated by Nebula Craft Design Ltd, registered in England and Wales, company number 17180534, registered office at 61 Bridge Street, Kington, HR5 3DJ, United Kingdom.
These terms apply to the PaceOut app, the website at getpaceout.com and related services we provide. By using a service, you agree to these terms and the Privacy Policy. If you are using PaceOut for a child, you confirm that you are an adult with authority to do so.
2. The product and family roles
PaceOut provides tools for parents and children to follow a visible screen-time rhythm. Features may include family pairing, pace plans, broad category controls, status views, warnings, time requests, notifications, Apple Watch or widget surfaces and a Plan Builder.
The parent or account holder chooses the family settings, accepts Apple permissions, controls invitations, reviews requests and decides what is appropriate. A child does not become an independent contracting account holder merely by using a child-facing screen.
3. Eligibility and authority
You must be able to enter a binding agreement in your place of residence, or use PaceOut with the involvement and permission of an adult who can do so. You must provide accurate information where the app or a support flow asks for it. Do not use PaceOut to monitor a person or device without the authority and permissions required by law.
4. Operation and dependencies
PaceOut depends on Apple services and permissions, including iCloud, Sign in with Apple, StoreKit and Family Controls. Device, operating-system, network, Apple-account and permission changes can affect availability or synchronisation. We will show a useful state where we can, but cannot guarantee that every feature works on every device or at every moment.
The app may apply local screen-time controls and share selected family state through Apple services. Exact app selections, tokens and some enforcement data are handled locally as described in the Privacy Policy.
6. Child safety and responsible use
PaceOut is intended to support calm family conversations, not covert surveillance or punishment. Explain the family plan to the child, use the least intrusive settings that meet the household need, and check what information is visible on each device. Do not use a pace state, notification or device control as the only way to respond to an emergency, safeguarding concern or medical issue.
Children may contact a parent or a trusted adult about information they see in the app. Security, privacy or child-safety concerns can be reported to legal@getpaceout.com.
7. Apple Standard EULA
The PaceOut app is licensed, not sold. The app uses Apple's Standard Licensed Application End User License Agreement. These terms supplement that Standard EULA. We do not adopt a custom PaceOut EULA in these terms. If Apple's EULA and these terms address the same subject, the applicable Apple terms govern the licence relationship to the extent required by Apple's rules.
8. Acceptable use and security
You must not misuse the service, interfere with its operation, bypass Apple or PaceOut controls, access another family without permission, submit unlawful or harmful content, attempt to discover private provider data, or use the website to send spam, abuse or malicious code. Keep your Apple account and device secure. Tell us promptly if you believe a pairing invite, account or device has been compromised.
9. Privacy
Our Privacy Policy explains the information used by the app and website, including Apple CloudKit family records, local Screen Time state, optional analytics, support, Plan Builder email delivery and Partner Programme applications.
10. Changes and availability
We may update the service or these terms to reflect product, provider, legal or security changes. The effective date and version above identify the current terms. We will give notice of material changes where reasonably practicable. We may suspend or discontinue a feature where necessary for security, law, Apple platform changes or service operation. This does not affect rights that have already accrued or mandatory consumer protections.
11. Intellectual property
PaceOut, its software, designs, text, artwork and related materials belong to Nebula or its licensors. We give you a limited, personal, non-exclusive, non-transferable right to use the service for its intended family purpose. You retain rights in information you submit, while giving us the limited permission needed to operate and support the service.
12. Liability and consumer rights
We are responsible for providing the service with reasonable care and skill and for digital content or services to the extent required by applicable consumer law. If the service is faulty or does not conform to a description, you may have rights to repair, replacement, repeat performance, a price reduction or other remedies depending on the circumstances and the law that applies to you.
Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, breach of mandatory consumer rights, or anything else that cannot lawfully be excluded or limited. Subject to that, we are not responsible for loss caused by your device, Apple account, network, permissions, unauthorised use, or information you chose not to back up. We do not promise uninterrupted availability or that the product will meet every family need.
13. Ending use and deletion
You can stop using the website or app at any time. A parent can start account deletion from the app's Settings where that feature is available. The app attempts to remove known CloudKit family records before clearing local account state; a retry may be needed if the remote step cannot complete. Subscription cancellation is separate and must be managed through Apple.
14. Governing law
These terms are governed by the law of England and Wales. If you are a consumer, you may also have the protection of mandatory laws in the country where you live, and nothing here prevents you from relying on those protections or bringing a claim in a court that has jurisdiction over you.
